The Ocean County Deadlines, With the Statute Numbers Attached
Two statutes sit under the deadlines above. N.J.S.A. 2A:14-2 is the two-year rule for any action “for an injury to the person caused by the wrongful act, neglect or default of any person.” N.J.S.A. 59:8-8 is the Tort Claims Act notice rule: when the defendant is a public entity, a written claim must be presented “not later than the 90th day after accrual,” suit waits six months after the notice is received, and a claimant who skips it is “forever barred.” N.J.S.A. 59:8-9 lets the Superior Court accept a late notice within one year of accrual, but only on a showing of extraordinary circumstances. Around here that means a county vehicle on Route 37, a township sidewalk, a public school bus, or a municipal beach walkway.
