Know Exactly What You’re Facing
Every Title 39 charge has its own point value, its own defenses, and its own leverage in negotiation. Start with the charge checked on your summons:
- Speeding (39:4-98) — 2 to 5 points depending on speed; radar, LIDAR, and pacing evidence are all challengeable.
- Careless driving (39:4-97) — the State’s catch-all 2-point charge, and one of the most negotiable.
- Reckless driving (39:4-96) — 5 points and real jail exposure; frequently overcharged, frequently reducible.
- Driving while suspended (39:3-40) — escalating penalties, and mandatory jail when the suspension traces to a DWI.
- Driving without a license (39:3-10) — no points, but repeat convictions carry jail exposure, and it’s a different charge from driving while suspended.
- Driving without insurance (39:6B-2) — no points but heavier than most point tickets: suspension exposure, three years of MVC surcharges, and mandatory jail on a repeat.
- Cell phone / texting (39:4-97.3) — fine-only at first; the third offense brings 3 points and suspension exposure.
- Leaving the scene (39:4-129) — points, suspension, and jail exposure even when the accident was minor.
- E-bike violations (new 2026 law) — New Jersey now requires licenses, registration, and — for throttle e-bikes — insurance; kids and adults alike are getting real Title 39 summonses on two wheels.
Ticketed on the Palisades Interstate Parkway? Those cases are not heard in a local municipal court — they go to the special Court of the Palisades Interstate Park, where common violations use park ordinance numbers (speeding § 413.1B, careless driving § 411.1W) instead of Title 39.

The points come next — reach 6 within three years and the MVC bills you an annual surcharge; reach 12 and the MVC moves to suspend your license.
