Two Deadlines Every Monmouth County Crash Victim Is Up Against
New Jersey gives you two years to file a car accident lawsuit under N.J.S.A. 2A:14-2: an action for injury to the person “shall be commenced within two years next after the cause of any such action shall have accrued.” If a public entity’s vehicle hit you, or a dangerous condition on public property caused the crash, the Tort Claims Act (N.J.S.A. 59:8-8) requires a written notice of claim “not later than the 90th day after accrual,” and a claimant who misses it is “forever barred.” In Monmouth that covers a county road crew on Route 537, a municipal police car, or an NJ Transit bus. N.J.S.A. 59:8-9 lets the Superior Court excuse a late notice within one year of accrual, but only for extraordinary circumstances, so we send the notice first and argue later.
