The Deadlines That Decide Cases
Most New Jersey injury claims must be filed within two years — but claims against public entities (county roads, municipal sidewalks, public buildings, NJ Transit) require a Tort Claims Act notice within 90 days. The evidence clock runs even faster: video loops overwrite, vehicles get repaired, witnesses scatter. Our checklist of what to do after a crash applies to nearly every injury case.
No-Fault, the Verbal Threshold, and Why Your Own Policy Matters
Your PIP coverage pays medical bills first regardless of fault. Whether you can recover for pain and suffering often depends on the verbal threshold election in your own policy, and when the at-fault driver carries minimum coverage, your UM/UIM coverage is frequently where the real recovery comes from. Shared-blame arguments are governed by comparative negligence — partial fault reduces, not eliminates, a claim.
Local Facts Win Local Cases
Monmouth County injury victims are treated at Jersey Shore University Medical Center in Neptune, Monmouth Medical Center in Long Branch, Riverview Medical Center in Red Bank, and CentraState in Freehold. Injury litigation runs through the Monmouth County Superior Court in Freehold. We know these roads — Route 36’s summer beach traffic, Route 9’s truck volume, the Parkway’s Exit 98–117 merge crashes — and we build cases on that local detail.
No Fee Unless We Win
Injury cases are contingency-based: we front the costs and only get paid when you recover. The consultation is free and honest — if a claim is small enough to resolve without counsel, we’ll say so.

The Statutes Behind Those Monmouth County Deadlines
The two-year clock above is N.J.S.A. 2A:14-2, which requires an action “for an injury to the person” to be “commenced within two years next after the cause of any such action shall have accrued.” The 90-day notice is the Tort Claims Act, N.J.S.A. 59:8-8: a claim against a public entity must be presented “not later than the 90th day after accrual,” and a claimant who misses it is “forever barred.” N.J.S.A. 59:8-9 lets the Superior Court accept a late notice within one year of accrual, but only on a showing of extraordinary circumstances and only if the public entity has not been substantially prejudiced. In Monmouth that reaches a county road in Howell, a borough sidewalk in Red Bank, a public school bus, or a fall at an NJ Transit station.
Where a Monmouth County Injury Suit Is Filed and Heard
Injury lawsuits go to the Superior Court of New Jersey, Law Division, Civil Part, Monmouth Vicinage, at the Monmouth County Courthouse, 71 Monument Street, Freehold, NJ 07728. That is where motions are argued and a jury is picked if the case goes the distance.
Arbitration Comes Before a Monmouth County Jury
Court Rule 4:21A-1 sends auto-negligence cases, and personal injury cases other than professional malpractice and products liability, to non-binding arbitration before trial; the rule makes arbitration mandatory on Tracks I, II and III, and R. 4:21A-1(c)(1) lets a court remove a case that involves novel legal or unusually complex factual issues. Under R. 4:21A-6(b)(1), a party who rejects the arbitrator’s award has 30 days from the filing of the award to demand a trial de novo. We prepare for the arbitration like it is the trial, because the award sets the tone for every negotiation after it.
Monmouth County Crash Numbers From the State Police
The New Jersey State Police recorded 25 fatal crashes in Monmouth County in 2025, with 26 people killed. NJSP labels these figures “unofficial and subject to change” until each investigation is completed; the 2025 county table is on the NJSP 2025 fatal crash statistics page.
