People assume a fake ID is a fine and a lecture. New Jersey law disagrees. Under N.J.S.A. 2C:21-2.1, conduct involving fraudulent identification documents can be charged as an indictable (felony-level) crime — not a municipal slap on the wrist. The grading depends on what happened:
- Making or selling fake IDs is treated most seriously, as a second- or third-degree crime.
- Using a fake ID to commit fraud, or possessing one with intent to use it fraudulently, is generally a third- or fourth-degree crime.
- Possessing someone else’s real ID with intent to misuse it is also covered.

The surprise that catches everyone: a license suspension with no car
Here is the penalty that blindsides families. Under New Jersey law, an underage drinking or possession conviction can carry a driver’s license suspension of up to six months — even if the person was not driving, was nowhere near a car, and was simply standing in a bar. For a student who commutes to school, works, or lives somewhere with no transit, losing a license for half a year is often a bigger blow than any fine. Most kids have no idea this penalty exists when they decide to plead guilty and move on.
Why the record matters more than the night
The arrest is over in hours. The record is not. A conviction under 2C:21-2.1 is a criminal conviction that can surface on background checks for years, and underage-alcohol findings can do real damage too. We are talking about:
- Job and internship background checks
- Financial aid eligibility
- Graduate, law, and medical school applications
- Professional licensing — nursing, teaching, finance, the bar
- Security clearances and some housing applications
For a young person with an otherwise clean slate, protecting that slate is the entire goal. The fine is forgettable; the record is not.
The charges that ride along
Fake ID and underage drinking cases rarely come alone. The most common add-on is hindering apprehension — giving police a false name to avoid being identified, which is its own offense and is treated more seriously than the underlying drinking charge. How we protect a young person’s record
The good news: a first offense with a clean record is exactly the kind of case the law gives a path out of. We focus on:
- Intent. For a fake ID, did the person actually possess it with purpose to use it fraudulently? That is the core element, and it is not always there.
- The search. How was the ID found, and was that stop or search legal? An unlawful search can take the evidence — and the case — off the table.
- The grading. Pushing back when the State overcharges, like treating simple possession as if it were manufacturing.
- Diversion. For eligible first-timers, Pretrial Intervention (for indictable charges) or conditional dismissal in municipal court can resolve the case without a conviction.
- Expungement. A dismissed or diverted charge can often later be cleared through expungement, so it never shows up again.
