Completing a conditional dismissal feels like the finish line — the charge is dropped, the case is over. But there’s one more step most people don’t realize they need, and skipping it leaves a trail. The arrest, the charge, and the diversion can still surface on certain background checks. Expungement is what removes them from public-facing records for good.
Dismissed isn’t the same as erased
When a charge is dismissed — through conditional dismissal, conditional discharge, or any other route — the court’s disposition changes, but the underlying records of the arrest and proceeding don’t automatically vanish. They sit in state repositories and can appear on background checks unless you take the affirmative step of having them expunged. Expungement is the legal process that isolates and removes those records so, in the eyes of most of the world, the event never happened.
The timeline
New Jersey sets waiting periods before you can apply, and they depend on how the case ended:
- Charges dismissed outright or you were acquitted: generally eligible to expunge essentially right away — there’s no waiting period for a true dismissal or not-guilty result.
- After a diversionary program like conditional dismissal or PTI: typically a six-month waiting period after completing the program before you can apply.
- After a conviction: longer waiting periods apply — these are a different track with their own rules.
Because conditional dismissal already ends in a dismissal, the path to a clean record afterward is relatively short compared to expunging an actual conviction.
The forms and the process
An expungement in New Jersey is a petition filed with the Superior Court in the county where the matter was handled. In practice it involves gathering the precise case information (dates, docket numbers, the disposition, the arresting agency), preparing the petition and proposed order, and serving the relevant agencies — the county prosecutor, the Attorney General, the State Police, the arresting department, and the court. New Jersey has also moved much of this to an online e-filing system, which has streamlined things but not removed the need to get the details exactly right. A single wrong docket number or missed agency can stall the whole petition.

Expungement is paperwork-driven, and the paperwork is unforgiving. The two most common self-filing mistakes are (1) getting case identifiers wrong so the order doesn’t actually match the records that need removing, and (2) failing to serve every required agency.
