A fender-bender on Route 70, a quick lane change on Route 88, or a slow roll through a crowded parking lot at the Brick Plaza — and the officer hands you a ticket for careless driving. It’s important not to confuse it with its heavier cousin. Reckless driving (N.J.S.A. 39:4-96) requires willful or wanton disregard for safety and carries far stiffer penalties. Careless driving is the lower-level charge — but “lower level” is not the same as “harmless.”
The points — and why they’re the real problem
A careless driving conviction adds 2 points to your New Jersey driving record. Two points on their own won’t suspend your license, but points don’t live in isolation:
- They stack with every other ticket on your abstract, and enough accumulated points trigger MVC surcharges and, eventually, suspension.
- They’re visible to your auto insurer, who can raise your premium for years — a cost that usually dwarfs the fine.
- For a new or young driver, or anyone already carrying points, a single careless conviction can be the one that tips you over a line you didn’t know you were near.

How a careless ticket gets fought in Brick Municipal Court
